Judge describes legal battle for Metro Boss seat as bizarre

The legal battle for the Metro Boss seat between Anele Qaba and Dr Noxolo Nqwazi continued in the Port Elizabeth High Court on Thursday.

The Nelson Mandela Bay Municipality, Executive Mayor, Eugene Johnson and Nqwazi have asked the court to decide on who should occupy the seat in the interim.

This interim order will be in place pending a review of proceedings that took place at a chaotic council meeting two weeks when Nqwazi was appointed.

Qaba's appointment as an acting city boss took place a week later at a last-minute council meeting attended by 70 councillors excluding the ANC.

Listening to the heads of argument, Judge Glen Goosen referred to the matter as bizarre.

Goosen said in principal the Municipality was suing its council meaning that it was suing itself as an institution.

The Municipality's legal team says this matter is of urgency as it has caused confusion and chaos.

Judgement is reserved.
