The Department of Justice says it cannot confirm speculation that Sudan president Omar Al-Bashir, flew out of South Aarica late last night, amidst a political storm making headlines across the world, that he be arrested.
Al-Bashir has been attending the African Union Summit in Sandton, and was in the country yesterday when the Pretoria High Court issued an interim order preventing him from leaving the country.
The International Criminal Court has issued two arrest warrrants for the Sudanese leader for crimes against humanity against people of Darfur in South Sudan.
Justice Ministry spokesprson Mthunzi Maga says they have not yet verified reports that Bashir has left .
Maga says notice about his attendance was published in the Government Gazette, yet nobody objected about it in ten days. He says if there were any objections then they could have adviced him not to come.
Meanwhile, a Pretoria High Court judge will decide on Monday whether or not an order will be given to arrest Sudanese president Omar al-Bashir.
An urgent application by the SA Litigation Center was granted in court on Sunday to allow for the matter to be heard at 11:30am.
Al-Bashir flew into South Africa on Saturday evening to attend the 25th African Union Summit, being held in Johannesburg.
His foreign minister, Ebrahim Ghandour, said they were assured of diplomatic immunity by the South African government.
"We are not abiding to any decision of any Court we are guests here in South Africa and our immunity was assured" he said
