The case against a former Port Elizabeth community radio presenter, who had faced charges of sexual assault, has been withdrawn in the City's Magistrates Court.
The State Prosecutor who was ready to proceed with trial was however informed this morning that the case was being withdrawn.
Defence Attorney William Booth told AlgoaFM News that he filed another application for his client with the Director of Public Prosecutions, who then decided to withdraw the case.
"I lodged a representation to the DPP who oversees prosecutors in the Eastern Cape. The representations were based solely on the fact that we felt there was no reasonable prospect of a successful prosecution"
The state had alleged that the 36-year-old had made phone calls to a 24-year-old university student threatening to sexually assault her.
This would have been the first case of this nature to be tried in the Eastern Cape.
Booth says it's been a difficult year for his client.
