Former Nelson Mandela Bay Communications Director Roland Williams appeared in the Port Elizabeth Specialised Commercial Crimes Court on Monday where he successfully applied for bail pending leave to appeal his sentence being enforced.
The 50-year-old Williams has been in prison for the last 52 days after Magistrate Lionel Lindoor sentenced him to four years in prison after he was found guilty of breaching the terms and conditions of his sentence in 2018.
Williams petitioned the High Court in Grahamstown in January which was granted on 8 March.
He was granted bail of R10 000 on Monday and has now obtained the services of Danie Gouws as his new lawyer.
In 2018, Williams was sentenced to 36 months of correctional supervision, a suspended four-year prison sentence, and was fined R30 000 for defrauding Santam.
He was also ordered to back the R96 000 that had been paid out to him for a road accident that never happened.
Williams was arrested in November last year when he defaulted on his monthly re-payments to Santam as per his initial sentencing agreement.
The default on these payments was rectified but Magistrate Lindoor ruled that even though the outstanding monies had been repaid to the short term insurer, Williams was still in breach of his sentencing conditions.
As part of his new bail conditions, Williams must report to the Kabega Park police station every Wednesday and must inform the State if he decides to change his legal council again.
