The Public Protector has found that there were irregularities in the awarding of a tender for the supply, delivery and installation of toilet structures by the Amathole District Municipality in the Eastern Cape.
Advocate Busisiwa Mkhwebane addressed the media on Friday on her findings following several investigations conducted by her office.
One of these included allegations of maladministration, corruption and tender irregularities in the awarding of R631m contract by ADM to Siyenza, a company which reportedly did not exist.
However, the Public Protector found that the allegation of political influence in the awarding of the contract was unsubstantiated.
Mkhwebane has ordered the municipal manager of the Amathole District Municipality to ensure that appropriate disciplinary action is taken against all members of the Bid Adjudication Committee who were involved in the awarding of the Siyenza contract.
This must be done within 90 days.
"Among other things, the Municipal Manager must ensure that the Municipality’s Supply Chain Management policy is revised to include a framework outlining how further procurement in term of regulation 32 of Municipal Supply Chain Regulations must be done," she said.
The Hawks and the Asset Forfeiture Unit are also investigating the matter.
The DA in the Eastern Cape said it would be laying criminal charges against former ADM municipal manager, Chris Magwanqana, in East London on Monday.
Provincial leader, Nqaba Bhanga, said he failed to fulfil his fiduciary duties as the Accounting Officer at the time adding that irregular, fruitless and wasteful expenditure in excess of R103-million was incurred with respect to the toilet saga.
