The mother of a Uitenhage man who died in Livingstone Hospital in 2010 after undergoing surgery for a broken leg, says she will bring a civil suit against the Eastern Cape Department of Health.
This, after a Port Elizabeth magistrate ruled on Friday that no one can be held responsible for the death of 19-year-old rugby player Edward van Dyk.
Magistrate Innes Du Preez said the court was unable to determine whether Van Dyk's death was the result of an act or an omission on the part of any staff member at Livingstone Hospital.
During the inquest this week the court heard of staff shortages in the high care unit and that nurses had not checked on Van Dyk half hourly as instructed by the doctor.
