Prominent Port Elizabeth attorney Michael Randell appeared in the Commercial Crimes Court on Tuesday.
He is accused of defrauding Greenwood Primary School out of millions of rands.
During Tuesday's proceedings, state advocate Wilhelm de Villiers, asked the court to transfer the matter to the high court, but Randell's legal counsel, Danie Oelofse, was not happy with this as Randell is known to many of the judges.
Magistrate Louis Claasen instructed Randell to make a list of all judges he has appeared before previously adding that the matter will need to be taken up further with the Eastern Cape judge president.
The case was postponed to the 14th of May and Randell is out on warning.
His co-accused former principal, Patrick Shelver, has already been sentenced to 10 years in jail which was wholly suspended for five years.
He was also ordered to repay R600 000 to the school.
