Omotoso Trial could start from scratch


Cheryl Zondi, the 22-year-old who gave harrowing testimony about being sexually abused by charismatic Nigerian pastor, Timothy Omotoso, may have to relive those moments again.

That's if judge Mandela Makaula recuses himself from the case. He is expected to present his reasons on the 15th of March.

It has emerged that judge Makaula has shares in a guesthouse used by state witnesses in the rape and human trafficking trial of Omotoso.

Judge Makaula had previously turned down a defence application to recuse himself and quash the charges.

Legal expert, Vinesh Naidu, of Legal Aid South Africa, outlines the implications of judges recusing themselves in cases before them.

He says first and foremost the Judge will have to give reasons for recusing himself, thereafter the trial will have to start again.

Naidu says Zondi would then have to be recalled to give her evidence again.
