Three Jesus Dominion International Church congregants have taken the ANC's youth league and women's league to court to prohibit them from protesting outside their church building in North End, Port Elizabeth.
Tempers flared last month when a group of protestors made up of various political parties and civil organisations gathered outside the JDI church calling for it to be shut down in the wake of a graphic testimony against their leader and rape accused, Timothy Omotoso, during his trial in the city's High Court.
Citing their reasons on the court interdict papers, the congregants said the three political groups, which also include the EFF, were interfering with their right to practice religion.
They added that they may suffer irreparable harm if the court order is not granted as they fear that the church will be destroyed.
The ANC's legal team said they would argue that the congregants have no grounds to bring the application on behalf of JDI church, that there is no cause for this action and that the matter is not urgent.
The case will continue on the 13th of November.
