Nelson Mandela Bay Municipality is gearing up for a court battle after talks aimed at finding a solution to the Metro's traffic fines impasse failed.
Pieter Swanepoel of Traffic Violation Services has alleged in court papers that traffic fines issued from January 2015 were done so illegally.
He alleges that the content of summonses and notices sent to offending motorists was often erroneous and did not comply with proper citation requirements as set out in the Criminal Procedures Act.
Respondents in the matter are the Nelson Mandela Bay Municipality, the National Director of Public Prosecutions and Traffic Management Technologies, the company responsible for setting up speed cameras in Nelson Mandela Bay.
Swanepoel says his legal counsel has met with the Metro's Safety and Security head John Best to try and find a solution.
"We tried to have a settlement out of court to see if we cannot come to some sort of conclusion to see if we cannot solve this problem causing a major hiccup" he said.
Best told Algoa FM News that the respondents have filed replying affidavits with the Court.
"I can confirm there were initially informal talks and those talks on the advice of our advocates we have withdrawn and we are letting the legal process proceed. It was not talks on the merits of the case, it was just to see the way forward and on advice of our legal team we have withdrawn from all negotiations" he said.
