One of four Port Elizabeth people charged with the murder of Walmer Country Club Manager, Gerrie Hoekstra, is facing a dilemma.
Forty-one-year-old Aburagmaan Hendricks must decide if he is going to withdraw his guilty plea or face 15 years in jail.
Hendricks had entered into a plea agreement with the state in which he would have pleaded guilty to Hoeskstra's murder in 2010 and serve a 10-year jail term.
However, judge Judge Murray Louw rejected the plea deal, saying that it was not just and he could not endorse a sentence less than 15 for murder and conspiracy to rob.
Both sentences would then run concurrently.
Judge Louw postponed the matter to next Thursday for Hendricks to make a decision.
Meanwhile, the other co-accused, 29-year old Sherwin Leander intends to proceed with a bail application based on new facts.
Thirty-two-year-old Charne Brown and 40-year old Karen Vander Merwe are both out on bail.
They will all be back in court again on the 17th of June next year.
The 61-year-old former EP rugby coach was gunned down during a robbery in November 2010.
