EFF leader Julius Malema did not appear in the East London Region Court on Monday but was represented by his legal counsel instead.
Malema is facing several charges for allegedly firing shots at the EFF's fifth Anniversary celebrations in Mdantsane in July 2018.
Afriforum laid charges against Malema, alleging that he had used an assault rifle.
Malema's lawyer Wikus Steyl told Algoa FM News on Monday that he received the dockets and would now ask the State for further particulars.
He says he also received four videos with footage of the alleged incident and will now consult with Malema and another accused.
Steyl says the weapon used by Malema was a toy gun and called the case against his client a "witch hunt" due to his profile.
The matter was postponed to the 8th of May for a possible trial date to be set.
According to procedure an arrest warrant for Malema has been stayed until his next court appearance.
