Le Bon Bakery suspect maintains his innocence

The only surviving suspect to be charged with the murder of Gqeberha Flying Squad member, Dwane Kemp, concluded his testimony in the city's High Court on Tuesday, maintaining his innocence.

Sibusiso Mchunu is accused of Kemp's murder and that of his four alleged accomplices who died during a botched robbery at the Le Bon Bakery in Central in 2019.

He has maintained his innocence throughout the trial, telling the court that he was in the Central on that fateful day to look for his cousin who had apparently stolen his father's firearm.

His cousin, Manidisi Jezile, and his three accomplices were shot and killed by Kemp's partner Sergeant Musa Hans, who returned fire after one of the suspects fatally wounded his partner Constable Kemp.

Mchunu told the court that he had accompanied his father to look for Jezile in Zwide, and then in the Central area before he returned there again to look for him in the afternoon.

State Advocate Mujaahid Sandan put it to Mchunu that he "conjured up an alibi" after his cell phone and car tracker placed him near the crime scene.

Warrant Officer Charmaine Bosch testified in October last year on the data analysis of Mchunu's cell phone records which tracked its whereabouts on the day of the robbery.

Bosch's analysis showed that the cell phone reception was picked up near the Le Bon Bakery when the robbery occurred.  It also revealed that the vehicle used for the commission of the crime, which belonged to Mchunu's father, was also picked up near the same vicinity around a similar time.

Meanwhile, his attorney Zolile Ngqeza told the court that his client has indicated that he would like to close his case.  The State obliged but said it needed more to prepare for its arguments.

The case has been postponed to the 7th of February.

Mchunu will remain behind bars.
