The Supreme Court of Appeal in Bloemfontein is expected to hear the appeal of Port Elizabeth musician Ian McLaggan against his rape conviction, from Friday.
Late last year, Grahamstown High Court judge, Glenn Goosen, found McLaggan guilty of raping an 18-year-old British tourist at Shamwari Game Reserve in 2010.
He sentenced him to eight years in jail.
In granting McLaggan leave to appeal, justice Plaskett said another court may come to a different conclusion.
At the same time, Plaskett also granted the State leave to appeal against McLaggan's sentence which State advocate Nickie Turner submitted was too light.
