The case against 31-year Xolilie Tose, who is accused of repeatedly raping a 6-year old girl in Motherwell in December 2011, has commenced in the Port Elizabeth High Court.
An emotional little girl, now 8-years old, took to the stand on Monday to tesify in camera.
Judge Jeremy Pickering had to adjourn the matter several times as the girl became emotional and tired.
Meanwhile, the mother of the child told the media that her daughter was no longer allowed to attend a school in Motherwell as the colostomy bag she had to wear because of her injuries, let off an odour and was a distraction to the other children.
Education Department spokesperson, Luyiso Pulumani says the child being barred for these reasons is a double discrimination.
"The rights of a learner are paramount, it is absolutely completely unacceptable in such a traumatic situation- if the allegations are true that the child is denied access to the school, it would be very irregular." says Pulumani
