EL affected by magistrates strike


East London was one of two centres affected by a work to rule protest by magistrates who are members of the Judicial Officers Association of South Africa on Monday.

Justice Ministry spokesperson, Mthunzi Mhaga, says the other courts affected by the strike were in Kimberley.

JOASSA is demanding a single salary structure for the bench in terms of which pay parity will be achieved with judges.

Mhaga says other than the two courts mentioned, all other courts were functioning as normal.

"I can confirm that nationally all the courts have been functioning normaly except Kimberley and East London where the president of JOASSA is actually presiding. Tomorow we will ensure that we have acting magistrates who are going to proceed with any cases which were set down for trial," he said.

Mhaga also pointed out that the strike or go-slow was illegal.

"What the magistrate's are doing in terms of postponing cases without a valid reason is unlawful and therefore they can be subjected to disciplinary action by the Magistrates Commission and that may lead to impeachment by parliament," said Mhaga.
