Just a day before crucial by-elections in the Kouga Municipality, the Democratic Alliance which is vying to take control of the Council, was dealt a blow by the Supreme Court of Appeal.
The court dismissed a DA application on Tuesday, with costs, for the review and setting aside of the appointment of several people to managerial positions within the Kouga Municipality.
The DA had challenged the appointments on the grounds that the decision did not comply with the requirements of the Local Government: Municipal Systems Act.
A full bench of the Appeals Court said it called attention to the approach of the high court in Grahamstown, saying the judgement by Justice Revelas was cryptic.
In addition the SCA noted that leave to appeal was granted without reasons being given, which left the Court none the wiser' as to the considerations that weighed with court below and and with no guidance as to why the matter was thought to be deserving of the attention of the Appeals Court.
