Case against double murder accused postponed for judgement in PE High Court


The case against double murder accused, Morne van der Linden, has been postponed for judgement in the Port Elizabeth High Court.

He pleaded guilty to killing his wife's 79-year-old grandmother, Catherine Stofberg and her 54-year-old son Kenneth Morar, in August last year.

However, he maintained that his actions were not premeditated.

In closing arguments on Wednesday, State Advocate Jason Thysse argued that van der Linden acted with intent to kill both the grandmother Catherine Stofberg and her son Kenneth Morar.

Thysse said that the fact that a hammer belonging to van der Linden was found at the scene shows that he went to the house in Salsoneville armed.

He said after van der Linden killed Morar outside the house, he went even further by going inside the house with intention to kill 79-year old Stofberg.

Thysse said that after suffocating the elederly woman he went on to kick and drag her into the bedroom and that under these circumstances it amounted to dolus directus-acting with intention to kill.

Meanwhile, Defence Advocate, Elsabet Theron argued that there was no indication prior to the murders that showed van der Linden had a grudge towards the family.

Theron said that no blood was found on the hammer and that a forensic pathologist excluded it as a murder weapon.

She also questioned the timing the hammer was placed at the scene, whether it was placed at the Salsoneville home in the morning when van der Linden first went there, or if the hammer was placed there later that evening when the murders took place.

The case was postponed until Thursday for judgement.
