Andile Lungisa to go home after 8 days in prison

Andile Lungisa, moments before he started serving out his two-year sentence for assault


Jailed ANC councillor, Andile Lungisa, has been granted bail in the Grahamstown High Court pending his application for leave to appeal his two-year jail sentence to the Constitutional Court.

Bail of R10 000 was granted on Friday by Judge Motilal Rugananan who also extended his bail conditions.

Lungisa began serving his sentence late week after the Supreme Court Appeal dismissed his application.

The Judges who made the call, are now reportedly demanding an apology from Lungisa, who criticised their decision in an interview before his incarceration last week.

He was sentenced to three years in jail with one year suspended for assaulting DA councillor, Rano Kayser during a brawl in Council in 2016.

Meanwhile, the Department of Correctional Services says Lungisa will be released, as soon as it receives the warrant of liberation from the court.

In extending his bail, Judge Rugunanan ordered that he remain resident at his place in Walker Drive, Port Elizabeth, until such time that his appeal to the Constitutional Court is determined.

Lungisa also has to hand over his travel documents to the clerk of the court by Wednesday and report twice weekly in-person to the Kabega Park police station.

Judge Rugunanan ordered that should Lungisa's application to the Constitutional Court fail, he will have 72 hours to present himself to the clerk of the court for incarceration.

Lungisa has already served 24 days of his two-year sentence.
