Jailed ANC councilor Andile Lungisa will hear on Friday whether or not he will receive bail pending his application for leave to appeal in the Constitutional Court.
The Nelson Mandela Bay councilor began serving an effective two-year sentence last week, after losing his bid in the Appeals Court for leave to appeal his sentence.
He was sentenced to three years with one year suspended for assaulting DA councilor Rano Kayser with a glass jug during a brawl in Council in 2016.
His bail application was argued earlier this week in the Grahamstown High Court before judge Motilal Rugunanan.
Meanwhile, the judge president of the Court of Appeals, Mandisa Maya, and four other judges, as well as the judge president of the Eastern Cape, Selby Mbenenge, demanded that Lungisa apologise for his remarks when he reported to start serving his two-year jail sentence.
The Court of Appeals dismissed his application for leave to appeal his sentence.
According to the public broadcaster, Lungisa said his case was not heard fairly because there’s political interference and corruption at the Court of Appeals.
The judges reportedly said in a statement that Lungisa's remarks undermined the integrity of the judiciary and amounted to contempt of court.
