The National Prosecuting Authority said the appeal application of Nelson Mandela Bay ANC councillor, Andile Lungisa, will be argued in the Grahamstown High Court on 13 March.
That's according to NPA provincial spokesperson, Tsepo Ndwalaza.
Lungisa, who is out on bail, is appealing his conviction and an effective two-year sentence for assaulting DA councillor, Rano Kayser, with a glass jug during the infamous Council brawl of 2016.
His lawyer, Alwyn Griebenow, said they filed their papers in the High Court in December after leave to appeal was granted in August and that they were now waiting for the state to file their papers.
Ndwalaza said the state would file their heads of argument before 13 March.
"We are in the process of submitting those papers. Basically, its an affidavit. We have enough time to do that and we are in our rights," he said.
