A Port Elizabeth man who is charged with the brutal rape of a six year old girl two years ago, will face cross-examination from state prosecutors on Thursday.
A high court judge rejected an application by 33-year-old Xolile Tose for the case against him to be dismissed.
Tose has pleaded not guilty to raping the girl over a 15 hour period.
The attack was so brutal that the child, now eight years old, has to wear a colostomy bag.
During his evidence in chief on Wednesday, Tose denied having anything to do with the attack on the girl in Motherwell.
