The young Port Elizabeth man accused of killing PE flying squad member Dwane Kemp has denied that he had used his father's gun in the Le Bon bakery robbery.
This was revealed when the man’s attorney read out his replying affidavit in the Magistrate’s Court on Wednesday.
The 24-year-old, who cannot be named, said that his father's firearm, which was reported missing on 22 January, was not kept in a safe at their home in Algoa Park.
He said the gun was thus easily accessible to anyone living with them or who visited their home.
His statement further claimed that his cousin who resided with him in Algoa Park and was an accomplice who was killed in the robbery could have easily stolen the gun and used it in the robbery in Central late last month.
The court heard earlier that the suspect’s father’s car was also in the vicinity of the bakery on the day of the robbery.
Kemp died in hospital after sustaining gunshot wounds when he and his partner came under fire while responding to the robbery call. His partner shot and killed four suspects, while the man in custody managed to flee but was arrested days later.
The magistrate, Xolile Dlulisa, postponed the case to 4 March for the state's reply.
The suspect remains in custody.
