A case of murder has been provisionally withdrawn in the Uitenhage Magistrates court after a 53-year old man allegedly shot and killed a suspected thief.
Police warrant officer Basil Seekoei says the man appeared briefly in court on Wednesday but was released as the case has been withdrawn for further investigation.
A 23-year old suspected thief was shot and killed in attempt to flee the pig kraal that the man was guarding earlier this week.
Seekoei says he was shot at the front door of the man's shack in Kwanobhule.
He says the guard claimed to have been startled by someone kicking the front door.
Three shots were fired through the door wounding the alleged thief in the legs. He died at the scene.
