NPA to prosecute disgraced student Theuns du Toit

The family of Eastern Cape born Stellenbosch University student Babalo Ndwayana will most likely be breathing a sigh of relief after the NPA announced it intends prosecuting Theuns Du Toit.

Du Toit is accused of urinating on Ndwayana's belongings in his Huis Marais residence in May this year.

Shortly after the incident went viral after it was captured on video, Ndwayana's family pushed for criminal charges to be laid against Du Toit, who urinated on Ndwayana's desk, laptop and other study material.

The university has since expelled Du Toit for contravening the university's disciplinary code for students.

NPA spokesperson Eric Ntabazalila confirmed that Du Toit would face two charges.

"Yes, I can confirm that we've decided to prosecute the accused," said Ntabazalila.

"We will be prosecuting him on malicious damage to property and crimen injuria charges. But what Ndwayana has done is to give an instruction to the investigating officer to finalise the investigation before we put the matter on the court roll," he added.

Ndwayana is a first-year agriculture student living in the Huis Marais residence and filmed Du Toit urinating on his belongings, in his dorm room, in the early hours of a Sunday morning.

His father, Mkuseli Kaduka, who lives in East London, said at the time his son's big heart was standing in the way of legal action being taken as he was reluctant to go that route.

Kaduka then named and shamed Theuns Du Toit on his personal Facebook page as the fellow first-year responsible for the incident.
