Ball rolling in private prosecution case against former SARS boss Tom Moyane


The former Commissioner of the South African Revenue Service (SARS) Tom Moyane, made his first appearance in the Roodepoort Magistrates Court on Tuesday for the private prosecution case against him.

Moyane is privately being prosecuted by Advocate Gerrie Nel on behalf of Lerato Maila who is the mother of Moyane's grandchild and was in a relationship with Moyane's son at the time of the alleged incident.

According to Maila, she was assaulted at Moyane's house in Roodepoort in May 2018. He allegedly pushed her around and kicked her in the face before destroying her cellphone when he realised she was recording him.

Maila laid a charge with SAPS but nine days later the National Prosecuting Authority decided not to prosecute due to a lack of evidence.

A campaign official at Afriforum Natasha Venter says as long as high-ranking government officials evade prosecution due to their political influence, there cannot be equality before the law.

A date for his first appearance in the matter was set down for the 11th of December.

Moyane, who is being prosecuted for assault with the attempt to do grievous bodily harm as well as malicious damage to property, was instructed not to make contact with the victim or the mother.

He is also not allowed to discuss the matter with his son.
