Graeme Smith cleared of racism charges

Cricket South Africa has announced that former Director of Cricket, Graeme Smith, has been cleared by two independent arbitrators of racism allegations against him.

This emanated from CSA’s Social Justice and Nation-Building process where SJN Ombudsman, Advocate Dumisa Ntsebeza SC, made “tentative findings” regarding various persons, including Graeme Smith, but did not make “definite findings” on allegations before him.

Ntsebeza recommended that further formal processes take place to achieve finality on these issues. 

CSA said in a statement on Sunday that it had duly followed these recommendations by initiating a full arbitration process “before two independent and well-respected Advocates, Ngwako Maenetje SC and Michael Bishop.  

Cricket South Africa said the arbitration concluded that the was no “evidentiary basis to conclude” that Smith engaged in racial discrimination against player, Thami Tsolekile, or was “racially biased against black leadership at CSA.”

The arbitration also concluded that that the was no evidentiary basis to conclude that Smith’s appointment of Mark Boucher as head coach of the men’s Proteas team in 2019, rather than Enoch Nkwe, amounted to unfair racial discrimination.

Cricket South Africa was also ordered to pay Smith’s legal costs.
