This is according to MEC Zolile Williams' spokesperson Pheello Oliphant who confirmed this Algoa FM News on Tuesday.
The notice of the amendment of section 12 was signed off by Williams on the first of December and according to law, it will be effective from Friday the 16th.
Oliphant says MEC Williams considered all submissions including objections from political parties, organisations and civic society before making the decision.
This means that a collective executive with a ward participatory system will take powers away from the mayor and allow a new committee to run the city.
This will force the ANC and the DA to work together as the two parties have the majority of seats alongside the EFF.
Oliphant says in terms of the law of the Municipal Structures Act 117 of 1998, political parties are given 14 days from the day that the notice was signed to consult and elect their leaders who will form part of the Collective Executive System.
Meanwhile, Metro Executive Mayor Retief Odendaal says the multi-party government on behalf of the city lodged an inter-governmental relations dispute with the MEC of COGTA back in September and there has been no response from MEC Williams.
Odendaal says there has been no acknowledgement of receipt of the dispute nor any attempt to meet to find an amicable solution to resolve this dispute.
"It is the belief of the multi-party government in Nelson Mandela Bay that the MEC has greatly flawed in his administrative processes to implement this proposed change and that he was possibly willfully negligent for political expediency in this regard" he added.
The Mayor says the multi-party government intends on proceeding with instituting legal action against the MEC of COGTA in an urgent bid to prevent him from collapsing the Government and administration in Nelson Mandela Bay.
