A Kariega Magistrate has ruled that the voice notes a murdered Kariega farmer sent to his sister mere months before his death, can be admitted into evidence against his wife, who is the accused.
Natasha Van Eck, 57, has been charged with the November 2022 murder of her husband Gideon, 60, at the couple's Bakenkop farm just outside of Kariega.
In handing down judgment in an interlocutory application on Wednesday, the court ruled in favour of the State, permitting them to use Gideon's voice notes to his sister in which he discussed his marriage to the accused.
Defence attorney George Malgas brought the application before the court, in a bid to prevent the state from presenting the evidence.
Malgas argued that admitting the evidence would amount to hearsay and that the deceased could not give context to the content.
Van Eck, who is out on warning, alleges that she shot her husband in self-defence.
The murder trial will recommence on 11 July.
