The state has called for a guilty verdict for a former East London Correctional Services Officer accused of his wife's brutal murder last year
Forty-eight-year-old Simpiwe Mxosa, is accused of killing his wife Bulelwa, at their quarters at East London Correctional Centre last year.
During the trial, the court heard evidence from their nine-year-old daughter who spoke of the brutal incident she had witnessed.
State prosecutor, Andile Nohiya, told the court on Tuesday that there was a four-hour gap in Mxosa’s timeline of the events, saying it showed that he had no urgency in reporting that he had found his wife’s body in their quarters.
He said that based on the evidence given by the arresting officer, coupled with his conduct after the incident, his actions “are that of a guilty man.”
Mxosa was arrested outside a pub with his friends, less than a kilometer away from a police station, and four hours after he said that he found his wife’s body.
The state prosecutor further argued that Mxosa had painted a rather pretty picture of his family, whereas his daughter, who had testified in October, spoke of all the grim details of life with the alleged perpetrator, including suffering a broken arm in one incident.
Defence counsel Advocate Hendrick Erasmus, however, argued that Mxosa should be acquitted of all charges, as his daughter had “imagined” everything she attested to.
He says in cases like this, the husband is always the suspect, and every witness who testified against the accused was “simply lying.”
Before Erasmus could argue further against conviction, load shedding forced the court to adjourn to Thursday.
