PE High Court judge, Jeremy Pickering will pass sentence this morning on 33-year-old Xolile Tose, who was convicted on Wednesday of the brutal rape of a six year old girl.
In convicting Tose , Pickering described him as a pathetic witness, whose evidence was, at times, evasive and improbable.
He said the little girl's blood on a T-shirt he had worn was pivotal to his verdict,.
He had to discount the girl's evidence and her identification of him as her assailant, because a clinical psychologist had found that she was not competent to continue to give evidence.
Pickering said this meant that the defence could not cross-examine her.
Meanwhile, state prosecutor, Marlini Moodley, called on Pickering to impose a life sentence on Tose - saying that many people, commenting on social media, had called for the return of the death penalty.
