Trade Union Solidarity has applied to the Port Elizabeth labour court for an urgent interdict against Continental Tyres in a bid to stop retrenchments.
Deputy Secretary General, Johan Kruger says the basis for them continuing with the retrenchment process is an agreement read between continental and Numsa regarding the shift system being changed.
Kruger says the company is in the process of retrenching 125 workers.
"Our bone of contention is simply that Section 189 of the Labour Relations Act envisage a consultation process. You can't simply come and say that layoffs are going to take place. There must be a consultation, certainly with another party" he said
Numsa and Continental reached an agreement earlier in May following a month long strike.
