The murder trial of a 22-year-old gangster Marshall Thomas is expected to start in the Port Elizabeth High Court on Tuesday.
Thomas is accused of the murder of two-year-old Hakeem Baartman in November 2017.
The state alleges that Baartman was in Helenvale in an area called 'Die Gat' when gang violence erupted.
Baartman was hit in the head by a stray bullet and died at the scene.
A 17-year-old, who was Thomas' initial target, sustained a gunshot wound in the neck.
Police apprehended Thomas nearly six months later, whilst drinking at a tavern in Gelvandale.
He is facing a charge of murder and attempted murder.
