A Port Elizabeth second hand car dealer intends appealing his effective five year jail sentence for fraud.
Magistrate Johan Claasen on Thursday sentenced André Niemand to eight years imprisonment, after his earlier conviction for fraud - involving an estimated two million rand.
However, magistrate Claasen suspended three years of his sentence for a period of five years.
He also turned down an application by the defense for leave to appeal, as well as the state's application for leave to appeal the leniency of the sentence.
Niemand now has 20 days to petition the High Court for leave to appeal and his bail has been extended pending the outcome.
