A Port Elizabeth attorney and his wife, accused of fraud and theft, will spend Christmas at home after the Magistrate's Court granted them bail on Friday.
Attorney Phillip Masiza and his estate agent wife, Nomsa, are accused of defrauding city businessman Greg Billings out of 950 thousand rand.
It was revealed in court that Billings bought a house from Nomsa Masiza and between March and May last year she transferred the funds into the Masiza Inc Trust Account.
Billings did not get the keys to his property.
Phillip Masiza's attorney, Danie Gouws told the court that the couple was in the process of paying back Billing after the metro's Council took a decision to pay back Masiza's R1.9 million for his legal services.
Masiza was granted bail of R5000 and although the State opposed his wife's bail due to the fact that she is out on bail in another multi-million rand fraud case, she was granted bail of R10 000 and placed under house arrest.
Phillip Masiza was granted bail of R5 000.
The two are expected back in court on the 4th of February next year.
