Nigerian Pastor Timothy Omotoso and his two co-accused were dealt a partial victory in the Gqeberha High Court on Tuesday when the presiding Judge ordered that special entries be made in their court file.
The entry of only three of the seven irregularities, that the defence believes have been committed on the part of the State, has been granted.
The three entries are:
Other entries that Judge Irma Schoeman did not allow into the court file, among others pertain to the court's failure to investigate whether Ntelwa had suggested to witnesses they perjure themselves, the State's failure to disclose that Ntelwa formed a WhatsApp group on which he communicated with complainants.
Schoeman said some of the entries had become irrelevant because the accused were acquitted on certain charges where witnesses were allegedly encouraged to suborn themselves.
She also said the WhatsApp group referred to was formed and disbanded before the trial started.
Omotoso and his co-accused, Zukiswa Sitho and Lusanda Sulani, face 32 charges which include rape, racketeering, human trafficking, and assault.
In October, a Section 174 application to have the charges dropped against the accused was unsuccessful.
The trial was remanded to 24 June, for the defence to present their case.
