There was an intense debate in Nelson Mandela Bay Council today over the presence of Bongo Nombiba.
The ANC councillor recently lost his bid in the Supreme Court of Appeal in Bloemfontein to appeal his fraud conviction and subsequent five-year-jail sentence.
Opposition parties said that since he has lost his appeal he should not be in Council.
But, ANC councillor Andile Lungisa, says Nombiba remains a councillor as he is still pursuing the matter through the courts.
After a brief adjournment and obtaining a legal opinion, the Speaker said Nombiba has until the 12th of March to decide whether or not to petition the court's decision.
Nombiba was approached by ANA journalist Raahil Sain to comment on the matter but he declined.

An urgent motion of no confidence in Nelson Mandela Bay Executive Mayor, Mongameli Bobani and the 2018/2019 adjustments budget will take centre-stage at the council sitting.
The Patriotic Alliance's lone councillor, Marlon Daniels, with the help of the ACDP, submitted a motion of exigency yesterday.
Daniels, who voted for Bobani to become mayor after Athol Trollip was booted out last year, said the mayor only took instructions from the ANC's Andile Lungisa, who is part of his mayoral committee.
This will be the second attempt to remove Bobani from the mayoral seat.
