Mandela funeral scandal: Attorneys been waiting 7 years for final charge sheet

East London Magistrates Court

The fraud and corruption case against former Eastern Cape Health MEC, Sindiswa Gomba and 11 others has been postponed to the 28th of July.

They made another court appearance on Tuesday on a range of charges that include fraud, corruption and money laundering, linked to the Mandela Funeral scandal.

Meanwhile, the lawyers representing some of the accused have expressed dissatisfaction with the State's handling of the case.

The attorneys, Mark Frederiks and Andre Schoombee say after seven years, the state still does not have a final charge sheet.

They said a trial date cannot be set as they are unable to address the charges or instruct senior counsel without an indictment.

The accused include former Buffalo City mayor Zukiswa Ncitha, her former deputy Themba Tinta, Ondela Mahlangu, who was a senior BCM official at the time, ANC regional leader Pumlani Mkolo, Nosiphiwo Mati, Zintle Nkuhlu and her company Lilly Rose and Viwe Vazi and his company "Forty Wings".

The National Prosecuting Authority says it is the state’s case that Mkolo, Ncitha, Tinta and Gomba used their positions and influence to set in motion a scheme designed to defraud the municipality and to misappropriate municipal funds earmarked for the transportation of mourners to the various venues where memorial services were to be held.

The accused are all out on bail of R1 000 each.
