Judge Mandela Makaula has dismissed both applications brought by rape accused Nigerian Pastor Timothy Omotoso's defence counsel in the Port Elizabeth High Court.
He turned down the application by defence counsel Peter Daubermann for leave to appeal his decision not to recuse himself from the trial, and also denied the application that he quash the charges against Omotoso and his alleged accomplices Lusanda Sulani and Zukiswa Sitho.
The defence previously indicated that it wanted the matter to be heard in the Supreme Court of Appeal in Bloemfontein and that if the applications were not granted, they would petition the Supreme Court of Appeal directly.
Makaula said it was in the interest of justice that he allows this to happen and the case was duly postponed to the 10th of December.
Omotoso remains in custody.
