Former Eastern Cape's administration director-general Dr Loyiso Mbabane, appeared in front of the East London Magistrates court on Tuesday afternoon.
In January, Mbabane was arrested for allegedly raping his 24-year-old relative.
He's alleged to have raped her since 2005 when she was 15 year's old.
He was initially denied bail but it was later granted bail by the Bisho High Court.
Dr Mbabane resigned from his high profile Government job a few weeks after his arrest.
Mbabane's defence attorney Ellias Makhanya says at proceedings, the court remanded the case to the 15th of May - hopefully for the Director of Public Prosecution's decision on whether it will withdraw or proceed with the prosecution.
"What we sought to get from the State was whether investigations have been finalised or not. That is why we are raising an issue during the hearing, since the prosecutor did not have the docket in court and could not answer our questions" he said
