DA Eastern Cape Leader, Nqaba Bhanga, will be laying criminal charges in East London on Tuesday against those implicated in the Amathole District Municipality's toilet scandal.
This, after the Public Protector, found that there were irregularities in ADM's award of a tender worth more than R600m to the company Siyenza in 2015.
However, in her report released on Friday, advocate Busisiwe Mkhwebane found that was no political influence in the awarding of the tender.
Bhanga said the Public Protector’s report had found that former ADM municipal manager, Chris Magwanqana, had failed to fulfil his fiduciary duties as the Accounting Officer and as a result, irregular, fruitless and wasteful expenditure in excess of R103-million was incurred.
He said it was high time that those responsible for stealing money meant for the people of the Eastern Cape are put behind bars.
In her remedial action, the Public Protector ordered the ADM municipal manager to ensure that appropriate disciplinary action is taken against all members of the Bid Adjudication Committee who were involved in the awarding of the Siyenza contract.
She said this must be done within 90 days.
"Among other things, the Municipal Manager must ensure that the Municipality’s Supply Chain Management policy is revised to include a framework outlining how further procurement in term of regulation 32 of Municipal Supply Chain Regulations must be done," she said.
The Hawks and the Asset Forfeiture Unit are also investigating the matter.
