The Democratic Alliance says it will conduct an investigation on whether or not fraud convicted ANC councillor, Bongo Nombiba was in council legally after the Constitutional Court's ruling on the 6th of June.
The Constitutional Court turned down Nombiba's application for leave to appeal his five-year jail conviction and jail sentence for fleecing an NGO out R20 000 meant for a community project.
Speaking to the media on Wednesday morning DA regional caucus leader, Athol Trollip said that the party would follow the paper trail to see if Nombiba's attorney was not notified of the decision before the 2019/20 budget was passed.
The budget was debated and approved on the 21st of June.
Trollip said if the DA finds that the declaration of this court ruling was delayed opportunistically then it will challenge this in court.
Nombiba handed himself over to start his five- year jail sentence on Monday.
