DA councillor's alleged shooters have to wait longer for bail outcome

The men who allegedly shot and wounded DA Kouga ward councillor Jaques Alexander will have to wait another two weeks to see if their bail application was successful.

The five appeared in the Humansdorp magistrates court on Wednesday on charges of attempted murder, the possession of a stolen vehicle, firearms, and ammunition, and robbery with aggravating circumstances.

Luciano Jacobs, Athenkosi Gidane, Mthumzi Kani, Lutho Mbatha, and Andy Davids all denied that they were responsible for firing shots at Alexander outside of the municipality's headquarters in February this year.

This contradicts the statements of the investigating officer who said in an affidavit that two of the men had confessed to being the shooters.

According to the investigating officer, Jacobs, and Gidane had admitted to shooting Alexander on David's instruction.

On Wednesday, the defence argued that the bail application, while a Schedule 6 application, should be considered a Schedule 5 application as the state had failed to show who had committed the robbery with aggravating circumstances.

In response, the state said this should not be determined by the bail court, and that the matter should proceed as a Schedule 6 application.

Acting magistrate Tiffany Potts said she would rule on the relevant schedule and hand down her judgment on the bail application on 7 August.
