A Port Elizabeth-based pilot who was charged in a culpable homicide case on the Port Elizabeth beachfront in May last year has been acquitted of all the charges against him.
Zimbabwean national, Kelvin Zirema, was acquitted of drunk driving and culpable homicide in the city's Regional Court last week.
According to his attorney, Alwyn Griebenow, there was no evidence upon which the court could convict him.
He said after three applications by the state for postponements because the witnesses were not there, the court held an enquiry and refused any further postponement.
Griebenow says after that the state closed its case and based on the evidence presented at that stage of the proceedings it was insufficient for a conviction.
Thirty-three-year-old Anthony Agbo was killed while a local woman, Nomawethu Mpuntshe lost a leg in the accident on Beach Road.
