Eastern Cape Cooperative Governance MEC, Xolile Nqatha, has announced his intention to invoke Section 139 (1) of the Constitution to take over the running of the administration of Nelson Mandela Bay.
In a statement, he said he would be making this recommendation to the Executive Council of the Eastern Cape Province.
Nqatha said that this was due to, amongst other things, the failure to fill the vacant post of Executive Mayor, appointing “an unqualified official to the position of an acting Municipal Manager” and the failure to address issues raised by the National Treasury.
He added that Mvuleni Mapu was “unqualified to act as an MM because currently, he occupies a position that is below that of managers who are accountable directly to the MM.”
The MEC also said that for Nelson Mandela Bay to have an acting Executive Mayor since last December cannot be in the interest of good governance.
“The intention to intervene in the Metro is occasioned by the urgent need to instill a culture of the respect for the rule of law and good governance,” said MEC Nqatha.
He has already written to acting mayor, Thsonono Buyeye, to inform him of his intention and said that that he now had to provide reasons why the Provincial Government should not intervene in the affairs of the Metro.
Nqatha said that his letter must be tabled in Council for a response within seven days of receipt.
