Bhisho High Court rules in favour of Mabuyane in academic qualifications saga

The Special Investigating Unit (SIU) said it will be studying the judgment in the Bhisho High Court today which granted an interdict in favour of Premier Oscar Mabuyane, halting the Unit's probe into aspects of his academic qualifications.

The Bhisho High Court on Tuesday found in favour of Part A of Mabuyane's application, which was to interdict the SIU's probe into him, while Part B of his application seeks to declare the SIU investigation against him invalid.

Mabuyane amended his initial affidavit, which sought to have the SIU's Presidential proclamation declared invalid, but now wants the investigation against him to be reviewed and set aside.

During a legal argument last week, his lawyer told the Court that he was the victim of abuse, as his right to privacy was violated by the SIU when it operated outside of the parameters of the proclamation signed by President Cyril Ramaphosa.

SIU spokesperson, Kaizer Kganyago, told Algoa FM News on Tuesday, that the SIU would comment on the way forward once their legal team has studied the judgment.

President Cyril Ramaphosa signed a proclamation last August authorising the SIU to probe, among others, serious maladministration in connection with the affairs of the University, and improper and unlawful conduct by officials at Fort Hare.

The probe followed incidents of violence which led to the murder in January of Mboneli Veseli, the bodyguard of Fort Hare University Vice Chancellor, Professor Sakhela Buhlungu, and the murder of Fleet Manager Petrus Jooste in East London last year.

Five people, Bongani Peter, Sicelo Mbulawa, Wanini Khuza, Mthobisi Khanyile, and Mthobisi Dlamini/Zondo, were charged with murder and attempted related to several incidents at Fort Hare University.
