Balcony murder trial to resume on Monday


The murder trial of a Gqeberha woman who was allegedly thrown from a fourth-floor balcony was postponed in the city's High Court on Thursday.

Malibongwe Dwabayo, 55, is accused of the premeditated murder of his 39-year-old girlfriend, Andiswa Mpiyana.

Her body was discovered on 3 July 2022 in the parking lot of the block of flats where the accused lived in Central.

Police had initially opened an inquest docket pending further investigation.

Thorough investigation and further probing by the investigating officer, Detective Sergeant Ridwaan Baatjies however led police to believe that she did not commit suicide, instead foul play was suspected.

The state alleges that the couple was involved in an argument inside the flat during the early hours before the discovery of her body.

It is alleged that they struggled physically and that the struggle continued to the balcony.

According to the charge sheet, the accused allegedly picked up the deceased and threw her over the balcony.

On Thursday, the case had to be postponed because State Advocate Ismat Cerfontein had taken ill.

Two forensic pathologists, a witness who said he saw the couple argue at a party a day before her death, and the deceased's mother has already testified on behalf of the state.

Dwabayo's bail was extended and the trial will resume on Monday.
