Arguments continued in the Magistrates Court in Gqeberha on Tuesday where murder accused Arnold Terblanche is fighting to get bail.
Terblanche is accused of being the mastermind in the murder of his estranged wife Vicki who was found dead in a shallow grave at Greenbushes in October last year.
State Prosecutor Marius Stander said the accused's third attempt at bail is also an attempt to get a copy of the police docket.
In his legal arguments, Stander said the State would not fall into what he called a trap.
He further argued that Terblanche's claim that the State was not playing open cards and was withholding evidence from him was simply not true.
He said Terblanche himself admitted to having had access to evidence that includes Whatsapp messages and voice notes between several parties in the case.
The state’s about-turn in Vicki Terblanche’s drug use was also in sharp focus during Tuesday's proceedings.
When Arnold was arrested last year and subsequently applied for bail, the state said Vicki was not using drugs, only now to admit she had been using drugs on the days leading up to her murder.
To this, Stander once again came to the defence of Investigating Officer Kanna Swanepoel explaining that Vicki had passed all her drug tests when she was required to undergo them.
He told the court as the investigation unfolded additional evidence to the contrary came up and was immediately furnished to the court.
