Andile Lungisa has only days to report to prison

ANC councillor, Andile Lungisa, will have to report on Thursday to begin serving his effective two-year jail sentence for assaulting DA councillor, Rayno Kayser, during the infamous 2016 Council brawl.

However, his lawyer, Alwyn Griebenow, says that they will be applying to the Grahamstown High Court to extend his current bail, pending an application to the Constitutional Court, also on Wednesday, for leave to appeal his sentence.

Last week the Supreme Court of Appeal rejected his application for leave to appeal the sentence, saying that it found no grounds to interfere with the sentence imposed by the trial court.

Lungisa was sentenced to three years in jail for the assault, with one year suspended.

Griebenow told Algoa FM News that part of Lungisa's bail conditions was that the Department of Justice and Corrections served notice on him at around noon on Tuesday giving his client 48-hours from receipt of the notice to report to the clerk of the court to begin serving his sentence.

He said "even if we submit the (bail) application", Lungisa still has to report to authorities.

Griebenow said the bail application will be lodged in the Grahamstown High Court on Wednesday and a date arranged for the hearing.
