An ANC councillor in Nelson Mandela Bay, Bongo Nombiba, has failed in his last bid to stay out of jail.
The Constitutional Court has turned down his application for leave to appeal his effective five-year jail sentence following his conviction for fraud in the Port Elizabeth Commercial Crimes Court.
In its ruling, dated the 6th of June, the Constitutional Court said the application for leave to Appeal should be dismissed as it does not engage this Court's jurisdiction.
Furthermore, the eight judges said that in any event, Nombiba's application bears no prospect of success.
The Court did not make a cost order.
Nombiba, a councillor in Ward 20 in Nelson Mandela Bay, was found guilty last March of fraud and money-laundering for pocketing R20 000 meant for a community project.
